The use of Defence flags (including the Naval Ensign) is restricted under the Defence Act 1903 s83(3). In accordance with the Defence Act, the Naval Ensign is not available for use by the public. Organisations with close links to the Air Force, such as RSL, Legacy etc. are governed by strict rules on how and when they are to display or fly the Ensign flag.
